The campaign:

In 2010, citing recent changes to the Competition Act, ICBC ceased negotiating with the ARA regarding the rates it pays its suppliers. Instead, ICBC chose to unilaterally set rates for industry suppliers without any meaningful consultation or participation from the ARA or any of its members.

The ARA is asking its members to help fund the cost of filing an application to the federal Competition Bureau seeking an opinion. The associated legal fees could reach as much as $100,000 or more.

We are asking you to donate $200, $500, $1,000, or an amount equivalent of up to 2% of annual revenue (or 1% of annual revenue if over $1,000,000). The fees will be used to hire a lawyer specializing in competition law and the costs of filing the relevant documentation with the federal Competition Bureau. We have been advised this fee alone is in the neighbourhood of $15,000.

We cannot engage legal counsel until such time as we have received sufficient funds from member contributions. The goal we are pursuing is $100,000. Any funds that are not used will be refunded back to the members who contribute on a pro-rated basis based on the amount they contribute relative to the total collected. No funds will be collected from members until we have commitments sufficient to cover our collection target.
